Bitstamp, the cryptocurrency exchange headquartered in Luxembourg, has become the first in the country to receive authorisation as a Crypto-Asset Service Provider (CASP) under the EU’s Markets in Crypto-Assets (MiCA) regulation. The EU is facing a “high degree of legal uncertainty” over how to regulate stablecoins jointly issued by entities inside and outside the bloc, the European Systemic Risk Board tells The Banker. The existing Markets in Crypto Assets Regulation does not cover stablecoins which have both EU and non-EU issuers — a gap that, according to the ESRB, threatens an increased likelihood of “redemption runs”, reports David Whitehouse. The board, which oversees financial stability with support from the European Central Bank, has proposed extending existing rules to include third-country, multi-issuer schemes. The ESRB recommends that the European Commission interprets MiCA legislation as not permitting multi-issuer stablecoins from outside the European Union. If the schemes are allowed to continue to operate, they should be subject to a dedicated new framework, the ESRB declares. Member countries are “diverging” in their current interpretation of the rules, an ESRB spokesperson adds. The commission is working towards clarification “as soon as possible”, a spokesperson said, while signalling opposition to a new dedicated framework. However, the commission is at odds with the ESRB’s stance and believes MiCA can provide solutions. “We believe MiCA provides a robust and proportionate framework for addressing risks stemming from stablecoins,” the spokesperson added.
