The Centre for Trade and Investment Law (under the WTO Chairs Programme) recently hosted a Trade Talk on Security Exceptions in Domestic and International Courts/Tribunals at Dr. Ambedkar International Centre, New Delhi. The discussion centred on an issue that has rapidly moved from the periphery to the core of global trade and investment discussions: the growing reliance on emergency powers and security exceptions in trade and investment regulation. As governments increasingly frame economic policies - including tariffs, export controls, and investment screening - as matters of “security,” the traditionally clear boundary between economic security and national security is being reshaped. Our session sought to unpack how these developments are unfolding across legal and policy frameworks. We were honoured to have Hon’ble Justice S. Ravindra Bhat, Former Judge of the Supreme Court of India, deliver an insightful keynote address, that examined the legal foundations, constitutional considerations, and broader policy implications of this evolving trend. Moderated by Prof. (Dr.) James J. Nedumpara - Head, CTIL, our distinguished panel brought together diverse and experienced perspectives from government, private practice, academia, and international litigation: • Mr. Sanjay Chadha - Director, Public Policy (India & South Asia), Uber; Former Additional Secretary, MoCI • Mr. Sanjay Notani - Partner, Economic Laws Practice (ELP) • Ms. Moushami P. Joshi Senior Counsel, Husch Blackwell, USA • Ms. Sujaya Sanjay - Associate, CTIL The Panel delved several critical themes, including: · the United States’ ongoing litigation on emergency economic powers and the future of tariff authority; · the evolving approach of WTO Panels and investment tribunals on the limits of “essential security interests;” and · the implications of these developments for India’s strategic and regulatory space. We extend our sincere appreciation to all the speakers, participants and colleagues who contributed to the Trade Talk at the Dr. Ambedkar International Centre, New Delhi. The Panel discussion offered fresh perspectives and nuanced insights on an issue that continues to shape the future of the global economy. As security narratives increasingly drive trade policy, deeper legal reflection and informed dialogue are essential - and this Trade Talk was one important step in that direction.
