The Dutch Supreme Court rejected the Russian Federation’s final appeal against the more than USD 50 billion awarded to the former Yukos majority shareholders. The arbitral awards, issued unanimously in 2014, remain the largest ever granted in the history of international arbitration. This decision brings an end to the long-running setting-aside proceedings before the Dutch courts and confirms the awards in full. We are proud to have supported our clients throughout this landmark matter. It reflects years of dedicated work, rigorous advocacy and close collaboration across disciplines and jurisdictions. A sincere thank you to the team that prepared and argued the case before the Supreme Court (Tobias Cohen Jehoram, Jan-Willem M., Johan Valk, Renate Keijser, Maarten Jansen, Sientje Dam), and to everyone who contributed at earlier stages (including Marnix Leijten, Albert Marsman, Matthias Kuscher, Irina Buga, Jonas Hinrichsen, Eline van de Langerijt, Iulia-Georgiana Croitoru, Daniël van der Nat, Linda Zilberte, and many other colleagues and former colleagues). Today Irina Timp and I represented the Anne Frank Stichting at the Hof van Justitie van de Europese Unie, even in the Grand Salle. A Belgian non profit organisation published the result of 13 years of scientific research (by the KNAW - Koninklijke Nederlandse Akademie van Wetenschappen and the Stichting) into the writings of Anne Frank, online in Belgium. There her work is in the public domain. The same is true for almost all EU countries. There are some residual copyrights in parts of her work in The Netherlands, which territory is geoblocked by state-of-the-art technological measures. Still, the copyright holder claims copyright infringement in The Netherlands because those of ill intent in that country could circumvent geoblocking measures, using certain VPN services, to access the publication. In short the question is how to reconcile local copyrights with the right to (scientific) information for the hundreds of millions of people in the public domain countries.
