    No lull this summer. Energy and digital infra deal activity is 📈 . The Blumen team has been busy this August supporting a number of diligence efforts with >50 site portfolios and a whole lot of nat gas + battery + data center projects. Water rights will increasingly be a siting constraint and a permitting timeline driver for data center and small modular nuclear sites. Water data is mostly managed at the state level. Surface and groundwater off take availability is published differently in every state. Blumen has standardized water datasets that help developers site, permit, and design their campuses to account for off take availability and thresholds that trigger permitting. So your project is in a basin with active adjudication, the onsite well is permitted, but only for irrigation, and you're eyeing industrial use. Nearby wells exist, but their rights are already spoken for. You're also sitting in a special administrative area with its own metering rules, and every new application gets run through a tangled web of New Mexico statutes. Have you figured out: - Are there valid, transferable rights on-site? - Are nearby wells industrial-use or irrigation? - Will the MVAA guidelines restrict your use? - Can you draw enough water and stay below the permitting radar? This established the Public Land Survey System (PLSS) to systematically parcel out the western territories of the United States. That is the system still used by the federal government to legally determine ownership and division of over 1.5 billion acres of land across 30 states.     𝗣𝗿𝗼𝗷𝗲𝗰𝘁 𝗼𝘃𝗲𝗿𝗹𝗮𝗽𝗽𝗶𝗻𝗴 𝘄𝗶𝘁𝗵 𝗳𝗲𝗱𝗲𝗿𝗮𝗹 𝗹𝗮𝗻𝗱? Developing energy projects on federal land can be cumbersome, even with permitting reform. If this is new territory, one thing to get familiar with are Resource Management Plans (RMPs). Think of these as zoning for federal land. RMPs identify areas designated for energy development versus those protected for wildlife, recreation, or cultural resources. They establish specific mitigation requirements, seasonal restrictions, and environmental constraints that directly impact project feasibility and costs. Figure out which RMPs your projects are subject to and the mitigation requirements associated. Miss those and you will be a few million dollars off your forecasted budget and timelines.
