  • Especially in prominent oil and gas areas, mineral estates and surface estates are typically severed (owned separately). In nearly all cases where minerals and surface are severed, the mineral estate is dominant. This means the mineral owner, or their lessee (like an oil & gas company), has the legal right to use as much of the surface as is “reasonably necessary” to access and develop the minerals. From the surface (pun intended), some developers erroneously assume above-ground infrastructure only effects what the eye can see. However, it’s important to dig deeper (another pun!), to understand mineral estates and their implications underlying your project. Before issuing a formal insurance policy to a project, title companies often require project developers to obtain subsurface waivers to clarify limits and compensation for infrastructure. Like securing land, obtaining subsurface waivers requires relationship-building with owners and can be a lengthy process depending on the number of stakeholders involved. Neglecting to understand underlying mineral estates while sprinting to secure land is a common mistake. As queue deadlines approach, many projects fall through the cracks by failing to secure waivers in a timely manner.   • A recent curative project had us telling our client they had secured surface waivers from the wrong chain of title! A legacy oil and gas operator leased a mineral owner 65 years ago. His heirs and their successors collected oil and gas royalties for 60 years. Now they just received payments for surface waivers. As it turns out, the original lessor on that oil and gas lease was not the rightful owner. He had the same name as the rightful owner, and had a similar vintage, but came from a different region of the country. The rightful owner's heirs are now making a claim. What now?
