  • Patty Pirri, Esq. from MTG's New York office wrote a legal memo entitled, "Amendments to Real Property Law (“RPL”) § 275 and Real Property Actions and Proceedings Law (“RPAPL”) § 1921" "New York State Senate Assembly Bill 2739[1] (the “Bill”) was signed by Governor Kathy Hochol on December 12, 2025, and is effective immediately. The Bill amends RPL § 275 and RPAPL § 1921 regarding the acceptance of payoff funds. The amendments to RPL § 275 and RPAPL § 1921 provide that if a mortgagor provides funds in reliance of a payoff statement at the location and manner specified, those funds must be accepted and applied to the unpaid principal, interest, and other fees. Funds tendered that are short of full payoff, which frequently occurs when fees and costs are added to the mortgage debt after a payoff letter is sent to a borrower can no longer be rejected, or placed in suspense."

  • MTG’s Mary Balthasar has authored an insightful article, “Online Account Access in Bankruptcy – Convenience or Right?”  "Do debtors have a right to make online mortgage payments while in bankruptcy?  Maryland Bankruptcy Judge Michelle M. Harner found a right to online mortgage payments and account access in the Chapter 13 case, Klemkowski v. CitiMortgage, Inc. (In re Klemkowski),[1] and that the failure to continue to provide the right was a violation of the automatic stay.  The policy of some mortgage creditors to not allow borrowers in bankruptcy the online account access they used prior to bankruptcy should be reviewed in light of this decision.  Attorneys representing debtors could refer to Klemkowski in arguing for greater account access in cases where desirable prepetition practices are not offered to a debtor in bankruptcy." .....   • We are excited to announce that Clayton Gordon, Esquire (“Clay”) is the Director of Complex Litigation and Strategic Development at McMichael Taylor Gray, LLC ("MTG"). Immediately prior to joining MTG, Mr. Gordon was employed by Carrington Mortgage Services, LLC since 2013, where he served as its Director of Default Mediation and Litigation. Clay is admitted to practice law in Florida, the District of Columbia, and the U.S. District Court for the Southern District of Florida. Clay has over 20 years of experience working in the real estate and consumer finance space as a litigator for both servicers and borrowers in state court, federal court, and bankruptcy court. He has served sellers and buyers as a real estate transactions attorney, written title insurance policies, and negotiated and drafted residential and commercial property agreements. Additionally, Clay has gained invaluable litigation experience in other legal practice areas, including insurance defense, commercial litigation, and admiralty and maritime law.In his role at Carrington, Clay led a team that managed contested foreclosures, eminent domain actions, title insurance claims, hazard insurance claims, HOA and eviction litigation, and much more. He also directed an attorney oversight team, document review and execution teams, and a team of corporate representatives who attended mediations, hearings, and trials. Clay lives in Jupiter, Florida, with his wife and two daughters, and enjoys college football (Go 'Noles!), offshore fishing, golf, traveling, and watching his girls play volleyball throughout Florida and beyond.

  • Aisle Matters Day 2 was a truly memorable experience for the MTG team.
