In a split decision, the Indiana Supreme Court recently held that an insurance company can avoid a bad faith claim arising from a loss with multiple claimants by filing an interpleader action, naming all possible claimants, and defending its insured. In so doing, the Court recognized a safe harbor for insurance companies to avoid potential bad faith claims for failing to promptly settle. Read the full Reminger Report from Charles Maiers below.

One of my professional goals for 2025 was to start building a mediation practice. To that end, I just completed a 40-hour mediation skills course through Northwestern University's School of Professional Studies, which is required in many jurisdictions to provide mediation services. I have served as a mediator on a volunteer basis for many years, and over the course of my career, I have participated in hundreds, if not thousands, of mediations as an advocate for one of the parties. The biggest takeaway is that mediation works. It is a cost-effective and efficient vehicle for dispute resolution and saves the participants time and money that would otherwise be expended in litigation or arbitration. For anyone who does not already know me, I have a nationwide practice representing public and private companies and individuals in the financial services, banking, brokerage, insurance, real estate, manufacturing, and construction industries in a wide array of cases involving breach of contract and fraud claims, issues relating to claims of unfair competition and trade secrets violations, and general tort litigation, with a primary focus on complex securities litigation and arbitration, financial institution litigation, compliance consulting, regulatory investigations and inquiries, and broker-dealer liability defense. George, Jr. – Louisville Timmy primarily litigates cases involving malpractice claims, employment law disputes, and premises liability matters.
