Under recent amendments, regulated entities that violate 42 CFR Part 2 – the federal law protecting the confidentiality of patients’ substance use disorder (SUD) information – now face expanded civil and criminal penalties, along with other enhancements to the enforcement process. Regulated entities should be prepared for increased legal exposure as federal regulators gain new enforcement authority. As summarized in recent Pulse Check articles, 42 CFR Part 2 underwent significant amendments in a Final Rule published on February 16, 2024, by the U.S. Department of Health and Human Services (HHS). The compliance deadline for those amendments is February 16, 2026. In a Fast Company article by reporter Gwen Moran published last month, Leah Stiegler shares her perspective on the legal risks that can arise from physical contact in the workplace, even when it’s meant to be friendly. Leah explains that courts consider a “two-pronged element” in harassment claims: whether a reasonable third party would find the act offensive, and whether the person touched felt it was offensive. She also notes that even conduct falling short of a hostile work environment can still expose employers to complaints and costly investigations. Her advice is simple and practical: “read the room.” Pay attention to context and nonverbal cues, and when in doubt, opt for a handshake or verbal greeting.
