In my 20+ years in commercial banking and in auditing, I’ve seen fraud perpetrated against banks—and I’ve worked directly to help prosecute it. What I’ve learned is this: white collar crime is still stealing. Too often, people ask, “Who did they really hurt?” when it comes to fraud or financial crimes. The answer? A lot of people. Customers. Employees. Communities. Fraud drains resources, erodes trust in our financial systems, and puts real people at risk. Just because it doesn’t involve a weapon doesn’t mean it’s victimless. And just because someone wears a suit doesn’t mean they shouldn’t face real consequences. Accountability must apply to everyone. In my banking career, we were acutely aware of the difference between earnings and cash flow. We had a saying: "Earnings don't repay loans--cash flow does." It was a reminder to always look beyond earnings and figure out the cash flow--the cycle of collections and disbursements. At times those cycles can vary widely; in fact, a company that otherwise appears profitable can suddenly find itself in a cash crunch. Transactional fraud involving financial institutions has received a lot of press over the past few years, and not just in banking publications. Topics like check fraud, ACH fraud, wire fraud, account takeover, and business email compromise have all been covered by the general press, AARP, local news channels, and the like. It’s easy fodder for the media because not only is transactional fraud growing at a rapid clip, it usually pits a consumer against some big meany financial institution, and that makes for great readership. In response to all of this, financial institutions have upped their transactional fraud game with new transactional fraud tools, new front-line fraud staff, and new fraud risk management programs. (Here’s hoping!) Ask a front-line fraud analyst about fraud and they’ll likely talk about how checks can be quickly scanned for fraud signs, and how incoming ACHs can now be held a few days if there’s suspicion of fraud, about wire call-backs and secret passwords, and the cool tools that can spot an online account opening attempt that fake. But ask them about loan fraud, and there could very well be silence. Some might reply with “I only handle transactional fraud on recurring transactions. We don’t view the making of a loan to be a transaction. It’s underwritten, approved, booked, and that’s it, other than ongoing payments which we don’t see because we sold the loan along with the servicing. Loan fraud isn’t part of our fraud program. I’m not saying we don’t care about loan fraud, but someone in lending takes care of it.” The irony in this is that if you add up the dollar amount of all the transactional fraud in the institution over an entire year, it’s probably still a small fraction of one commercial loan going belly up because of fraud. Institutions might have to rethink loan fraud and the governance around it.
