If you think that you may have an investment arbitration claim, the first thing you should do is NOT to call a specialist like me. I am a firm believer in transparency of laws, but that unfortunately does not apply to treaties (and laws) providing specific protection to foreign investment. So I wrote a very hands-on entry for the WAGNER Arbitration Investment Arbitration Manual on where to find those treaties (with links!). Their text is not nuclear science, so every in-house lawyer and a non-specialist should be able to read through them and take a preliminary view of whether their investment might be covered. You can then come to me if and when it starts to get more urgent / complex -- and after you have also read my earlier entry on the best time to file a notice of dispute 😉 (Not able to post the link to the entry here -- will try again in the comments)
