Warm welcome to the third Issue of my newsletter.

There is more and more of you joining me for a sIP and that's simply wonderful! Thank you!!!

So what have you signed up for?

A joyous mix of IP stuff, a bit of ever-present AI (just not present in my writing - that thing can't keep up with my style yet - ha ha!) and a whole bunch of other things in between: from videos to books and from IP events to journeys.

A loose structure of this Newsletter remains the same as in the previous issues, but I moved the order a bit, thus:

  1. First, I will share some assorted IP-related things I came across that I can't keep only to myself;
  2. This will be followed by some book recommendations (not my book! LOL)
  3. After that, I will invite you to have a glimpse into my notes filled with insights from the IP events I attended last month.
  4. Then there will be a quick recap of my posts together with some further links to super-curious materials (yes-yes, on AI!).
  5. And I will close with a review of/insights from the 50 minutes for the next 50 years of your life. What's that? Stick around and you will find out.

In between all of the above, I will boast a bit and may be make a joke or two (and will share some photos).

I. Assorted IP-stuff and a bit more

You obviously know what is hardware, right?

Are you sure? I thought I was.

Did you know that the term “hardware” is used in different ways within the context of #computerimplementedinventions?

According to this blogpost, hardware could be used at least as the following:

  1. Physical Components: According to the first definition, hardware refers to the machines, wiring, and other physical components of a computer or electronic system. It contrasts with software, which includes the programs that run on the computer. All computer-implemented inventions are considered to be implemented in hardware based on this definition.
  2. Computer Hardware vs. Other Electronic Hardware: The second definition distinguishes between computer hardware (implemented with software) and other electronic hardware (implemented without software). In this context, “hardware” specifically means not computer-implemented.
  3. Read-Only Memory (ROM) vs. Floppy Disc: The third definition arises from historical usage, where “hardware” has been used to contrast between a read-only memory (ROM) storing a program for a computer and a floppy disc storing the same program. Despite potential confusion, some computer-implemented inventions fall under this definition of "being implemented in hardware".

Pfff... Then, add to the above that according to “Introduction to Algorithms”, published by the Massachusetts Institute of Technology: “you should consider algorithms, like computer hardware, as a technology”…

So, nothing is entirely straightforward, huh? Not even hardware.

Curious what will be the outcome of the appeal in the case Comptroller-General of Patents, Designs and Trade Marks v Emotional Perception AI Limited. But we’ll see that after 14th of May.

Some people (and not only people) I follow (and I think, you should too)

  • Josh Gerben : he posts great stuff on trademarks. And on running a small business (which happens to be a law firm). And on top of that - I like his work ethics. And his podcast. In other words, check him out!
  • Eric Perrott from the same law firm as Josh, likewise, regularly posts insightful comments on trademarks and trademark strategy for the US market.

So if you are interested in trademarks and the US - those two gentlemen will give you a lot of food for thought.

  • Second, and this is not a person:

Do you know what is my current reflex when I am faced with any task that I used to spend a lot of time on? To check if there is an AI tool that can assist me in this or that way. And funnily, there is even a page on LinkedIn called “There is an AI for that” and they do frequently post some cool AI tools. Now, what do you know about Innovation?

And most importantly - why should you care?

Long story short, understanding types of innovation and thinking in terms of its dimensions (product vs. process; architecture vs. component, competence enhancing vs. competence destroying), when you are thinking about innovation, helps you to discover what must be protected and what must be the focus of your IP strategy.

In other words, that's important.

Understanding the types of innovation allows you to define production competencies, product features, customer benefits and business models that makes sense to protect in order to secure your market position today and in the future.

II. And... on to the books...

  • Jamie Jia Mei Soon-Kesteloot (Ph.D, LL.M, CPVA) often referring to The Art of War by Sun Tzu made me want to re-read it. I read it before already. Several times even: first one still in the lyceum and the second - around my MBA times. But now I felt it's time to read it again. It is brilliant! And, as Jamie rightly says, it is indeed SOOOO APPLICABLE TO THE WORLD OF INTELLECTUAL PROPERTY! "If you know the enemy and you know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle". You can take any quote from there and just think about your IP strategy through its prism - it will be super-relevant!
  • And once I am at it, let me share with you another short and very impactful read - “Who moved my cheese?” by Spencer Johnson. This is one of the must-read books for every professional! It’s about dealing with change in your work and your life. I highly recommend it!

III. A glimpse into my notes from events

As you can see, I have a lot of notes...

In fact, and this is an intermezzo - this is how I do it: in the Notes on my iPhone, synchronised with the Notes on my MacBook. In these Notes, there are articles I have in progress (by the way, Alex and Tobias Denk , I have an idea of writing about Superfakes for IP Business Academy - what do you think?), there are some notes from the events I attended, some assorted thoughts that come to my mind... Eventually, I go through all of them, structure what I can, go ahead with some other stuff. And bit by bit and step by step, move forward. On all 900+ of them.

And now back to the Notes from IP events.

If I was to note the main highlights, those would be these:

ECTA eTreat in The Hague

First of all, I really enjoyed this event, so thank you very (very!) much once again to ECTA (official) and Benelux Office for Intellectual Property (BOIP) for the organization!

So what did I bring home from it? There were two large themes: IP valuation and IP exhaustion.

IP valuation

Why does IP valuation matter? Frequently IP is the only asset of a startup. (And not only of a startup). It can be detrimental if you don’t secure your rights.

Stijn De Nijs talked about valuation of intangible assets and valuation methods:

Bart De Moor brought the perspective of an Insolvency practitioner. Valuation of IP is important also in the determination of the rights of the creditors that have to vote on a reorganisation plan and on the validity of that plan. But there is a significant lack of understanding.

By the way, fun fact: "IP" for insolvency practitioners most likely means… Insolvency Practitioner!… Hence, a lot of work to be done here for awareness building. And we need to be careful with abbreviations! Not everyone understands them the same way.

Nicole Stephanie Ockl shared an insightful experience of an IP lawyer moving in-house (to TUI), which is super-interesting as such. However, she also elaborated on how licensing works within TUI. The company has a position on owning IP and licensing it, not selling for a “one off", even when Covid hit them (and it did very hard, as you can imagine!) What I also noted from Nicole's presentation was her closing remark: “Don’t mess with the tax”. Yep. This one is especially relevant for in-company licensing. But obviously, not only. Just don't mess with the tax in general.

IP exhaustion

We heard the general overview of the matter, the UK perspective in the post-Brexit and, of course, IP exhaustion questions when it comes to upcycling.

Upcycling as such is essentially a recycling that results in a product with a higher value than the original. And here it can be done by deconstruction (when new products are built) or by using the original products, but adding or replacing parts (not for repair purposes!).

Some questions e.g. Maarten Haak highlighted on that Thursday were related to IP exhaustion: like if it is about the components, does one need to prove exhaustion per component? What about informing a consumer? What if the resulting product is in a completely different goods category (EPAL pallets vs upcycled pallets into clothes hangers)? How to balance upcycling and trademark rights here? In other words, questions are abundant! If anyone is searching for a research topic - voila! Go dig.

Bringing Cleantech to the market

This was a webinar organized by European Patent Office on the World IP Day.

Here are some notes from it:

  • Europe remains in the Lead, but watch out - since China is catching up quickly - In 2021, contribution of Chinese applicants surpassed that of EU applicants.
  • Cleantech in Europe face the usual funding gap and scaling-up challenges inherent to the continent's innovation
  • The EU single market remains the key focus for EU cleantech innovators and their favoured option to scale up
  • The recent creation of the Unitary Patent is a significant step forward towards addressing the need for harmonisation in the market for innovation
  • Continued focus on integration and improvement in regulatory clarity in the EU remains essential, for European cleantech innovators to derive the full benefits from the single market.

EUIPO IP Case Law Conference

Nope… Not this time! It has been an amazing two day event filled with insights to the top! I will report on it separately, otherwise my sIP is transforming into a full-fledged IP-feast…

Diamandis , Chairman and CEO of the X PRIZE Foundation, recently put together The 2024 Abundance Summit themed "The Great AI Debate," where some big names discussed whether digital superintelligence represents humanity's greatest hope or our gravest threat. In his blog, he summarized the key insights and revelations that came up during his discussions with Elon Musk, Eric Schmidt, Nat Friedman, Emad Mostaque, Michael Saylor, Ray Kurzweil, and Geoffrey Hinton. V. 50 Minutes for the NEXT 50 Years of Your LIFE

This is a compilation of five excerpts from Simon Sinek’s speeches (that's the author of “Start with Why”). I feel like it's important to reflect on them, irrespective of what is your professional role and - like this newsletter - it's a bit about everything.

I. From the beginning of the video:

  1. There are two ways to see the world: some people see the things they want, some others see what prevents them from seeing the things they want.
  2. Sometimes you are the problem! Take credit but also take accountability.
  3. Take care of each other. It is not how tough you are, you need to get really good at helping people to the right of you and to the left of you.
  4. Learn to be the last to speak. Keep your opinions to yourself, take it in, ask questions, try to understand.
  5. "The ceramic cup was never meant for me, it was meant for the position I held". You can accept all the perks, but be grateful for them.

II. Staring at around min 12 of the video:

  • You should never cry alone. Don’t need to fix anything, just come and sit in the mud together.
  • Leadership is about going first.

III. Starting at around 23 min:

  • Leaders need to have two skills: empathy and perspective. That’s the problem and that’s why we have not enough leaders, and a lot of managers, who are micromanaging.
  • Leadership is a skill. We have a capacity to be a leader but it comes at great cost.
  • Great leaders are not responsible for the job, they are responsible for the people, who are responsible for the job.

IV. Starting at around 32 min:

  • What are the costs of the benefits we get from technology? Because there is always a cost. Nothing is free.
  • Engagement with social media releases dopamine. It feels good when we get a response. It’s highly addictive. We have a whole generation with the access to highly addictive thing - social media and cell phones in general.
  • Trust doesn’t form in a day.
  • Ideas happen when our minds wonder.

V. Starting at around 43 min:

  • The problem with finite goals: Having your goal for your reasons alone is not fulfilling for any social animal, for any human being. Our sense of joy and fulfilment, and love and purpose comes from our ability to serve another human being.
  • There’s nothing wrong with setting goals, but they have to be in the context of something bigger.
  • See your life as a continuum, rather than as event - that’s much healthier.
