Op 26 november 2025 werd de Modelovereenkomst voor Allianties officieel gelanceerd op het symposium 'Samenwerken, van intentie naar impact'. David Orobio de Castro heeft in samenwerking met experts uit de sector meegewerkt aan het opstellen van deze nieuwe contractvorm. De Modelovereenkomst is beschikbaar gesteld op de website van AlliantieNed (alliantiened.nl); het netwerkplatform voor allianties in Nederland. In een alliantie werken opdrachtgever en aannemer samen in één projectorganisatie waarbij risico's van ontwerp en uitvoering samen worden gedragen. Over- en onderschrijdingen van het budget worden gedeeld. Dit leidt tot betere, efficiëntere samenwerking met minder discussies en geschillen en meer werkplezier. Allianties zijn ideaal voor complexe opgaven zoals vervanging en renovatie van infrastructuur. De nieuwe modelovereenkomst maakt deze samenwerkingsvorm toegankelijker voor de hele sector. Stibbe successfully advised Ardian on the closing of its strategic investment in the Diot-Siaci Group, a leading European corporate insurance brokerage provider. As part of the transaction, Ardian acquired the shareholdings of Ontario Teachers' Pension Plan, Bpifrance, Cathay Capital, and other minority shareholders, becoming Diot-Siaci's lead financial shareholder, alongside the Burrus Group and the management team. Thuiswerken: iets wat sinds de COVID-19-periode normaal lijkt, wordt in de praktijk steeds vaker door werkgevers ingeperkt. In hun recente bijdrage analyseren Auke-Frank Tadema en Yasmin Farzanh de juridische complexiteit rondom het monitoren van werknemersaanwezigheid op kantoor in het licht van de AI-verordening, AVG en WOR. Auke-Frank en Yasmin concluderen dat hoewel velen sympathie zullen hebben voor het idee dat personeel elkaar moet blijven ontmoeten op kantoor, het juridisch afdwingen hiervan niet eenvoudig is. Handhaving van thuiswerkbeleid zonder monitoring van personeel lijkt niet mogelijk en aan de monitoring kleven veel verschillende haken en ogen: met de AVG, de AI-verordening en de WOR ligt er een juridisch parcours dat minstens zo uitdagend is als de file op de dinsdagochtend. Zo blijkt dat de gewoonte van thuiswerken – ooit genormaliseerd uit noodzaak door de COVID-19-pandemie – zich niet gemakkelijk ongedaan laat maken. Stibbe successfully defended a UK company facing allegations of IT forgery, IT fraud, and online defamation. Central to the case was a key jurisdictional question: when can an alleged online offence be deemed to have been committed in Belgium, and is the mere presence of the alleged victim in Belgium always sufficient? The court unequivocally endorsed our position that, in this matter, it was not — bringing the proceedings to an end.
