Remote depositions have introduced a new cast of characters to the discovery process—and many of them aren’t on your radar. It’s a pattern we see across remote proceedings. With an in-person deposition, you know who’s there. Online, however, surprises occur. In remote sessions, the participant list expands: insiders log in silently, and unauthorized observers exploit weak room control. Sometimes it’s a muted associate in the virtual gallery. Sometimes it’s a family member just off-camera. In-person you had line-of-sight; online you may not. Are your protocols updated to account for this broader cast? Fortunately, most of these concerns can be addressed through a well-crafted remote deposition protocol. With a protocol in place, litigators can define in advance who is authorized to attend, and set clear ground rules for how each participant may engage. The ABA identifies this as a best practice, noting that parties should consider a stipulation or court order that clearly defines acceptable conduct during the deposition. Ultimately, the list of “dos” and “don’ts” is limited only by counsel’s imagination—making the protocol the primary tool for managing both legitimate remote attendees and those who might otherwise slip in unnoticed. Any aspect of the remote deposition process not clearly addressed by rule or stipulation becomes a risk point. Room access, participant conduct, device use, off-camera presence—if it isn’t spelled out in a protocol, it’s left to chance.
