Welcome to the November 18th edition of CREFC’s Policy and Capital Markets Briefing. CREFC, along with SIFMA and MBA, is asking the SEC to remove certain ABS posting requirements while keeping key conflict-of-interest safeguards in place, including NRSRO certification, separation of ratings from sales and marketing, and publication of ratings performance data. • 𝗖𝗙𝗣𝗕 𝗥𝗲𝗽𝗿𝗼𝗽𝗼𝘀𝗲𝘀 𝗟𝗲𝗻𝗱𝗶𝗻𝗴 𝗗𝗮𝘁𝗮 𝗖𝗼𝗹𝗹𝗲𝗰𝘁𝗶𝗼𝗻 𝗥𝘂𝗹𝗲 (𝗦𝗘𝗖 𝟭𝟬𝟳𝟭). On November 12, the CFPB reproposed its Section 1071 small business finance reporting requirements. These rules collect data on small business loan applications and originations, and do not exempt commercial real estate (CRE) mortgages. CREFC, along with other trade groups, has advocated in the past for an exemption for CRE and multifamily loans.
