The Paris Investment Arbitration Group (PIAG) was founded by Jelena Todić (Wordstone) and Charlotte Matthews (Hanefeld) with a view of bringing together a diverse community of international investment law professionals in Paris to exchange ideas, share insights, and stay updated on the latest developments in international investment law and arbitration. PIAG’s mission is to provide a forum for discussing curated issues in international investment law and arbitration while offering opportunities for members of varying seniority levels to connect. PIAG aims to promote intergenerational dialogue, bridging the perspectives of emerging and seasoned practitioners while ensuring gender equality.     📢 Actu de la sous-direction du droit de l'Union européenne et du droit international économique de la Direction des affaires juridiques du MEAE: 👌 La 3ème réunion sur la mise en service du Centre consultatif sur le règlement des différends relatifs à des investissements organisée par la France et le Secrétariat de la CNUDCI du 1er au 3 décembre a été un grand succès !   🌏 Les experts et délégués impliqués dans les travaux de réforme sur le règlement des différends investisseur-Etat étaient au rendez-vous, avec une centaine de participants représentant près de cinquante pays sur place à Paris ou connectés à distance.   📰 Tous les documents de travail préparés par le Secrétariat de la CNUDCI sur le budget, l’organisation ou le fonctionnement du futur Centre consultatif ont été examinés par les délégués, qui ont considérablement progressé vers la mise en service effective du futur Centre consultatif.   ✔️ Huit pays ont confirmé leur intérêt pour accueillir le Centre, dont la France 🇫🇷 qui propose d’établir l’un de ses bureaux régionaux à Paris, dans les nouveaux locaux en construction de l’Agence française de Développement (AFD).   👏 L’organisation de cette réunion de haut niveau a été une vraie réussite grâce aux membres de la délégation française auprès du Groupe de travail III de la CNUDCI, aux agents du Ministère de l'Europe et des Affaires étrangères et de la Direction générale du Trésor (French Treasury) et aux services du Centre de Conférences Pierre Mendès France à Bercy. Merci à toutes et tous !   ⏳ Les travaux sur la mise en service du Centre Consultatif se poursuivront lors de la prochaine session plénière de la CNUDCI, en vue d’une adoption définitive de ses statuts par l’Assemblée générale des Nations Unies, si possible d’ici à la fin de l’année 2026.

    📢 La France 🇫🇷 aura le privilège d’accueillir à Paris, du 1er au 3 décembre prochains, la 3ème réunion sur la mise en service du Centre consultatif sur le règlement des différends relatifs à des investissements.   📌 La réunion de Paris, après celles de Bangkok 🇹🇭 en décembre 2024 et d’Erevan 🇦🇲 en mai 2025, permettra de poursuivre les préparatifs en vue de la mise en service du Centre consultatif, qui est un élément clé de la réforme du règlement des différends entre Etats et investisseurs (RDIE) en cours d’élaboration dans le cadre du Groupe de travail III de la Commission des Nations Unies pour le droit international commercial (CNUDCI) 🇺🇳.     If you think that you may have an investment arbitration claim, the first thing you should do is NOT to call a specialist like me. I am a firm believer in transparency of laws, but that unfortunately does not apply to treaties (and laws) providing specific protection to foreign investment. So I wrote a very hands-on entry for the WAGNER Arbitration Investment Arbitration Manual on where to find those treaties (with links!). Their text is not nuclear science, so every in-house lawyer and a non-specialist should be able to read through them and take a preliminary view of whether their investment might be covered. You can then come to me if and when it starts to get more urgent / complex -- and after you have also read my earlier entry on the best time to file a notice of dispute 😉 (Not able to post the link to the entry here -- will try again in the comments)

    Global Arbitration Review has now reported below, based on the detailed press release by the Korean Ministry of Justice, that the ICSID ad hoc committee has annulled the only portion of the Lone Star v. Republic of Korea award that had found the Korean government liable, while dismissing Lone Star’s own annulment application in its entirety. In practical terms, this confirms that the investor ultimately did not succeed in establishing any wrongful conduct by Korea giving rise to State responsibility under the applicable investment treaty in the original arbitration proceedings. In that arbitration, however, the investor invited the tribunal to rely on findings from a separate ICC arbitration – a proceeding in which Korea had never participated as a party – and the tribunal accepted that invitation as a key basis for finding Korea internationally responsible under the treaty. The ad hoc committee has now held that this reliance on an ICC award rendered in proceedings to which Korea was not a party amounted to a serious departure from a fundamental rule of procedure, and on that basis annulled the only part of the award that had found Korea liable. I have great respect for the ad hoc committee for taking such a bold and principled approach in squarely addressing these due process concerns and upholding the rule of law in the annulment process. What remains is a clear message: the Republic of Korea treats foreign investors fairly and equitably, in accordance with the rule of law and its treaty obligations. For Korea as a host State, this case stands as a significant example of our consistent commitment to principled, treaty-compliant treatment of foreign investment — even when that conduct is scrutinized in some of the most demanding international fora. #ISDS #ICSID #InvestmentArbitration #RuleOfLaw #Korea

    Compensation under international law is evolving - reshaping how the world addresses challenges in critical areas such as climate change, human rights and investor–State arbitration. During our annual Public International Law seminar, hosted by the Ministry of Foreign Affairs (MFA) Singapore Permanent Mission to the UN in New York, leaders from across the international law field discussed this topic in depth, sharing key perspectives and insights. Here are three key takeaways: 1️⃣ Work of the UN ILC: The UN International Law Commission has good reason to reconsider the rules regarding compensation under international law, particularly in specialised areas such as climate change, human rights and investor–State disputes. 2️⃣ Proving loss: Causation remains one of the biggest challenges in assessing and quantifying loss for the purpose of awarding compensation. While this can be addressed through factual presumptions or mechanisms such as “global sums” of compensation, these approaches bring their own challenges. 3️⃣ New (and old) mechanisms for compensation: New approaches - such as Registers of Damage - are contributing to proposed models for large-scale harm compensation, alongside historical mechanisms such as the UN Compensation Commission.     Darrois Villey Maillot Brochier hosted, on Thursday, 23 October 2025, a debate organized by the Paris Investment Arbitration Group on the motion: “Is Paris a favorable seat for investment arbitration?” Our partner Carine Dupeyron took part in the lively discussion, arguing against the proposition alongside Mamadou Gacko (DLA Piper), in an engaging exchange with Luca De Maria (PMG Avocats) and Agnès Bizard (King & Spalding), who argued in favor of Paris. The debate was expertly moderated by Professor Mathias Audit (Audit Duprey Fekl) offering a thought-provoking and stimulating discussion on Paris’s role in the field of investment arbitration. Attended by nearly 70 participants, the discussions fostered a rich and engaging exchange, highlighting diverse perspectives on the advantages and challenges of Paris as a seat for investment arbitration.

    ❓ 𝗜𝘀 𝗣𝗮𝗿𝗶𝘀 𝘀𝘁𝗶𝗹𝗹 𝘁𝗵𝗲 𝗰𝗮𝗽𝗶𝘁𝗮𝗹 𝗼𝗳 𝗮𝗿𝗯𝗶𝘁𝗿𝗮𝘁𝗶𝗼𝗻❓ Just attended an excellent debate on why Paris is a favorable seat of investment arbitration. Following this event and discussions with Damir Biskaliyev, I decided to take a look at the broader picture. While the debate focused specifically on investor-state disputes, the general trends revealed in the new 2025 International Arbitration Survey by Queen Mary University of London and White & Case LLP provide crucial context. The survey shows that the competition is🔥 fierce 🔥 Paris remains a formidable seat, celebrated for stable case law and the pro-arbitral courage of its courts ⚖️ . Nevertheless, hubs like Singapore and Beijing are demonstrating remarkable growth (see the chart from the survey below). This is a trend that undoubtedly affects the investment arbitration landscape as well. It cannot be denied that geopolitics influences heavily the arbitration sphere. According to the survey: 🔴 30% of respondents chose a different arbitral seat because of sanctions; 🔴 27% faced administrative and payment challenges; 🔴 25% experienced difficulty finding counsel or arbitrators able to participate. The severity of recent sanction pressures (eg 18th EU Sanctions package on Russia) not only gives a clear signal to potential investors and states, but also may influence their choice of seat of arbitration. Concerns about access to justice are being raised. A Brave New World, indeed. Thanks to the organizers Jelena Todić, Charlotte Matthews, moderator prof.
