#DataProtection: 📢 NEW Guidelines clarify exceptions to data protection rules
The Committee of Convention 108 of the Council of Europe has officially adopted the “Guidelines on the Interpretation of the General Principles of Article 11 of Convention 108+”, marking a significant step in clarifying key provisions of the only legally binding multilateral treaty on data protection.
📌 What is Article 11 about?
Article 11 of Convention 108+ defines the conditions under which restrictions to data protection rules may be applied. These restrictions must be:
✔️ Provided for by law
✔️ Respect the essence of the fundamental rights and freedoms
✔️ Be necessary and proportionate in a democratic society
✔️ Serve legitimate aims such as national security, public safety, the protection of rights and freedoms of others, or the prevention of criminal offences.
📌 These guidelines offer the following key limits and safeguards:
🔹 Restrictions must be based on clear, accessible, and foreseeable laws
🔹 They must not be applied in a generalized or abusive manner
🔹 Oversight and accountability mechanisms must be in place
🔹 The core principles of data protection, such as lawfulness, purpose limitation, and proportionality, must not be negated
🔹 Restrictions should be limited in scope, time, and impact and subject to review.
